These Terms of Service ("Terms") govern your use of Lumamotion’s AI-powered content-generation services (the "Services"). By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Lumamotion may allow you to submit prompts, upload supported materials, select styles or settings, and create AI-generated images, videos, audio, text, or other content ("Generated Content"). Features may change, be unavailable in some regions, or be modified, suspended, or discontinued as reasonably necessary for operational, security, legal, or business reasons.
You must be at least 13 years old, or the higher minimum age required in your jurisdiction. If you are under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian.
You are responsible for all prompts, uploads, settings, and other content you submit ("User Content"). You represent that you own User Content or have all rights, permissions, licenses, and legal authority needed to submit it and use it with the Services.
You retain ownership of your User Content. Solely to provide, secure, and support the Services, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, process, modify, and transmit User Content to our service providers as necessary to generate and return your requested output. This license ends when the applicable content is deleted, subject to reasonable backup, legal, safety, and technical retention periods.
Subject to these Terms and applicable law, you may use Generated Content for personal and lawful commercial purposes, to the extent permitted by law and any third-party rights. You are responsible for reviewing Generated Content before using or sharing it.
Generated Content may be inaccurate, unrealistic, biased, offensive, unsuitable, or similar to content generated for other users. We do not guarantee that it is unique, non-infringing, fit for a particular purpose, or eligible for copyright protection. Do not represent AI-generated content as real or unaltered when that would be misleading or unlawful, and disclose its AI-generated nature whenever required by law, platform rules, or context.
You must not use the Services to create, upload, request, distribute, or facilitate content that:
We may use automated filters and, where reasonably necessary, human review to enforce these Terms. We may block requests, remove content, limit access, preserve records, or suspend or terminate accounts when we reasonably believe a violation, safety risk, technical issue, or legal requirement exists.
The Services may offer subscriptions, credits, premium features, or other digital benefits. Prices, benefits, billing periods, and renewal terms are displayed before purchase. Payments are processed by the Apple App Store, Google Play, or another authorized marketplace and are subject to that provider’s terms.
Subscriptions may renew automatically unless canceled through the applicable marketplace. Refund eligibility is governed by applicable law and the marketplace’s policies. Credits or virtual items, if offered, have no cash value, are non-transferable, and are non-refundable except where required by law.
The Services, including our software, interface, templates, graphics, logos, and other materials we provide, are owned by us or our licensors and protected by intellectual-property laws. Except for the rights expressly granted in these Terms, no rights are granted to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMAMOTION DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMAMOTION AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR USD $10. Some jurisdictions do not allow certain limitations, so these limits may not apply to you.
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, or if required by law.
These Terms are governed by the laws applicable where the Lumamotion service operator is established, except where mandatory consumer-protection law provides otherwise. Before initiating formal proceedings, you agree to contact us and attempt to resolve the matter informally for 30 days.
We may update these Terms to reflect changes in the Services, law, or our practices. We will post the updated Terms and revise the effective date. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
